activists who have brought this case to media's attention
have no personal stake in the case except to see justice
prevail. Rapidly breaking story. A multi-generation battle has raged between CPC/Bestfoods and the family who created the Skippy character. Frustrated with lack of justice in the courts, the current owner and daughter of the creator of the Skippy character put up a web site at www.skippy.com . This site tells the story of how CPC/Bestfoods had attacked the rightful owners of the Skippy trademarks and wrestled rights to food use of the trademark from them in 1986. Mrs. Tibbetts is a mid sixty year old widow whose husband died of a massive coronary as a result of previous CPC/Bestfoods actions. Russell Mokhiber and Robert Weissman
have told part of the story at : CPC/Bestfoods has responded with crushing litigation in an attempt to rewrite history. Last week CPC Bestfoods obtained an order for removal of extensive material from the Skippy.com website, much of which is factual. Mrs. Tibbetts complied with that order. Yesterday (8-19-99) CPC-Bestfoods filed yet another motion with the court in the United States District, Court For The Eastern District Of Virginia, Alexandria Division. The "Revised Order Of Contempt" tries to censor Mrs. Tibbetts, but even more important tries to silence all critics with very broad language which reads: "8. This Order and the order dated September 4, 1986, shall apply to Skippy, Inc., Joan Crosby Tibbetts, and all persons acting on their behalf or in concert with them who have or are given actual notice of this Order." The "Submission of Substitute Order of Contempt" motion states "It also appears that Skippy, Inc. and Ms. Tibbetts have engaged the assistance of others to spread their accusations against [this abrupt ending of the sentence is their mistake]. Therefore, Bestfoods has amended the Proposed Order of Contempt to extend to those who continue to act in violation of the Court's Order of September 4, 1999 after they have actual knowledge of it." The order issued on 9-7-99 is just as bad as the proposed Substitute Order and the Revised Order. It is my view that CPC and the court have railroaded Mrs. Tibbetts in the past and that they are again railroading her by not allowing her reasonable time to seek counsel. Their latest complaints were delivered (Saturday 21) and she is expected to respond by Monday 8-23-99. Judge (Richard L. Williams),who is hearing the case, held Joan Crosby Tibbetts in contempt of court, for telling the story of how she and her family have been raped by CPC/Bestfoods. It appears that the judge does not understand first amendment rights. The judge even went so far as to suggest to CPC/Bestfoods on 8-29-99 that they should move to have the Skippy corporate charter sold. This would allow the peanut CPC/Bestfoods to finish taking the rest of Joan Crosby Tibbitts property. This judge is hardly an unbiased dispensor of justice.
