[REVISED] ORDER OF CONTEMPT

 

Upon motion by plaintiff CPC International Inc., now Bestfoods by reason of change of name, this court on August 12, 1999 ordered Skippy, Inc. and Joan Crosby Tibbets to appear and to show cause why they should not be held in civil contempt or be otherwise sanctioned for violating this Court's Final Order dated September 4, 1986 in the above-entitled action,

Upon notice and hearing, and upon consideration of the submission of all parties,

IT IS HEREBY ORDERED THAT:

1. Skippy, Inc. and Joan Crosby Tibbets are guilty of civil contempt for their deliberate and willful violation of this Court's Final Order of September 4, 1986 ("Order").

2. The Order of this Court dated September 4, 1986, remains in full force and effect.

3. Skippy, Inc. and Joan Crosby Tibbets shall permanently remove the passages and titles listed on the attached Schedule A from anywhere in the Skippy.com Internet website,

including their use of metatags, no later than ____________________, and shall not replace those passages with text referring to or otherwise highlighting the deletion of those passages.

4. Skippy, Inc. and Joan Crosby Tibbetts shall not create nor assist others in creating websites that violate the Order of September 4, 1986 or this Order.

5. Skippy, Inc. and Joan Crosby Tibbetts shall remit to this Court a fine of _________ as sanction for their deliberate and willful violation of the Order.

6. Skippy, Inc. and Joan Crosby Tibbets shall remit to Bestfoods the sum of ___________as to compensate Bestfoods for the damage to the reputation and goodwill of Bestfoods in the SKIPPY trademark.

7. Skippy, Inc. and Joan Crosby Tibbetts shall remit to Bestfoods the costs and attorneys fees incurred by Bestfoods in bringing this contempt proceeding, as determined b this Court after submission of appropriate records by counsel for Bestfoods.

8. This Order and the Order dated September 4, 1986, shall apply to Skippy, Inc., Joan Crosby Tibbetts, and all persons acting on their behalf or in concert with them who have or are given actual notice of this Order.
